TIMING. The Henkel Corporation “Duck Tape Club® Duck® Brand Duct Tape “Saves the Day” promotion (“Promotion”) begins at 12:01:00 a.m. Eastern Time (“ET”) on July 1, 2008, and ends at 11:59:59 p.m. ET, October 31, 2008 (“Promotion Entry Period”). Entries must be submitted by the end of the Promotion Entry Period to be considered. Entries postmarked or e-mailed after October 31, 2008, will not be considered.

SPONSOR. The Promotion is sponsored by Henkel Corporation, 32150 Just Imagine Drive, Avon, Ohio 44011-1355 (“Sponsor”).

GENERAL. This Promotion is divided into two segments, a skill contest segment and a random sweepstakes segment.

ELIGIBILITY. The Promotion is open to legal residents of the United States, including the District of Columbia, but excluding Puerto Rico, 14 years of age or older at the time of entry who submit a valid Promotion Entry as defined in the Official Rules (“Entrant”). Employees of Sponsor, their family members, and persons living in the same household as employees or their family members are NOT eligible. All federal, state and local laws apply.

ORIGINAL WORK/NO INFRINGEMENT. By entering the Promotion, Entrant represents, states and agrees that the Promotion Entry is an original, true, factual, non-defamatory work, has not been previously published, including previously submitted in this Promotion, or won any award, and that Entrant is aware of no conflicting rights in the Promotion Entry including but not limited to copyright or other intellectual property right. Entrant represents, states and agrees that his or her Promotion Entry will not infringe upon the intellectual property rights of any third party, including by way of example and not by limitation, any copyright, trademark or patent rights belonging to any third party.

PUBLICITY/USE OF NAME AND LIKENESS. Except where prohibited by law, entry in the Promotion constitutes each Entrant’s consent for Sponsor to use Entrant’s name, city and state of residence, entry, likeness, photograph, image and Promotion Entry for advertising, publicity and promotional purposes in any media, online or offline, without further permission, consent, payment or other consideration.

HOW TO ENTER. Entry may be made on-line or by U.S. Mail. For on-line entries, each Entrant must go to www.ducktapeclub.com, click on “Saves the Day” and submit: (1) One (1) original, true and factual story no more than 250 words in length about how Duck® brand duct tape helped “save your day.” Entry may be accompanied by a picture illustrating the use, but pictures are not required and will not increase the Entrant’s chance of winning, and (2) Entrant’s first name, last name, address, phone number, e-mail address and age (collectively, “Promotion Entry” or “Promotion Entries”). Entry by U.S. Mail: Submissions of the above information should be sent to: Saves the Day Promotion, 32150 Just Imagine Drive, Avon, OH 44011-1355. Limit one submission per individual. Sponsor reserves the right in its sole discretion to disqualify any entry that Sponsor reasonably believes contains profanity or other offensive depictions, or that in any way may defame or jeopardize the good will or reputation of Sponsor or any third party.

PROMOTION ENTRIES. Promotion Entries become the sole property of Sponsor and none will be returned. By participating in the Promotion, Entrant assigns to Sponsor the Promotion Entry and all rights therein, including non-exclusive, irrevocable worldwide right to use, publish and copy the Promotion Entry in any media, in whole or in part, without geographical limitation or compensation to Entrant, including by way of example and not by limitation, display at the Duck Tape Club Web site, located at www.ducktapeclub.com.

JUDGING CRITERIA/NOTIFICATION OF WINNERS. One (1) Potential Winner will be selected from among all eligible Promotion Entries based on a composite score using the following criteria (“Judging Criteria”):

• Originality of story (20%)
• Creativity in telling story (20%)
• Ingenuity in Use of Duck® Brand Duct Tape (40%)
• Grammatical Correctness of Submission (20%)

Sponsor will score all eligible Promotion Entries based on the Judging Criteria and will select the Winner on or about 12:00:00 p.m. ET on November 12, 2008, at Henkel Corporation, 32150 Just Imagine Drive, Avon, Ohio USA. In the event of a tie score between two or more Entrants, the Promotion Entry that has the highest score in the category of Ingenuity in Use of Duck® brand duct tape will be selected as the Winner. Sponsor will notify the Potential Winners via e-mail or phone in accordance with the information provided by Entrant in the Promotion Entry. It is Entrant’s responsibility to ensure Sponsor has the correct e-mail address and phone number to notify Entrant of potential selection as a winner. In the event that Entrant’s e-mail address changes during the Promotion Period, it is Entrant’s responsibility to notify Sponsor of such change. Potential Winners must confirm receipt of Sponsor’s e-mail within seven (7) days of the notice date and sign and return an Affidavit of Eligibility and a Publicity/Liability Release (except where prohibited by law) or prize will be forfeited. Where a prize is forfeited, the Entrant with the next highest score in accordance with the Judging Criteria will be chosen as the alternate winner. The Winners will be announced by news release and will be posted on the www.ducktapeclub.com Web site on or about November 19, 2008.

PRIZES. SKILL CONTEST SEGMENT: From all Promotion entries received during the Promotion Period, the one (1) with the highest score (as set forth above) will receive a cash prize of $5000.00 and a year’s supply of Duck brand duct tape. Approximate retail value: $5100. SWEEPSTAKES SEGMENT: Ten (10) Winners chosen at random from all Promotion entries received will each receive $500.00 and a year’s supply of Duck brand duct tape. Approximate retail value: $600 each. The total value of all prizes is $11,100. The amount and value of “a year’s supply of Duck brand duct tape” will be determined at the sole discretion of the Sponsor. All prizes will be awarded. Where Winner is a minor, prize will be awarded in the name of parent or guardian. No substitution or transfer of prizes is permitted, except a prize of equal or greater value may be substituted in the sole discretion of the Sponsor. All taxes and other expenses are the sole responsibility of Winners. Sponsor will issue a 1099 form to winners (or their parent or guardian) receiving a prize.

TERMS AND CONDITIONS. Participation in the Contest constitutes Entrant’s full and unconditional agreement to and acceptance of these Official Rules. Sponsor reserves the right in its sole discretion to disqualify any entrant it finds to be tampering with the operation of the Contest or to be acting in violation with these Official Rules. Entrants agree that Sponsor, its affiliates, parents, subsidiaries, agents or contractors and their employees, officers and directors shall not be liable for injury, loss or damage of any kind resulting from participating in this Contest. Because this is a contest of skill, odds of winning depend upon the eligible Contest Entries received and Entrants’ final score, as determined by the Judging Criteria for the Contest. Winning is contingent upon fulfilling all requirements of these Official Rules and Sponsor’s decisions as to the administration of the Contest and prize awards are final. Sponsor reserves the right, in its sole discretion, to cancel, modify or suspend the Contest should fraud, technical failures, or any other factor beyond the reasonable control of Sponsor impair the integrity of the Contest, as determined by Sponsor in its sole discretion. In such event, Sponsor reserves the right to award prizes based on the Judging Criteria from the eligible Promotion Entries received up to the time of impairment. BY RECEIPT OF ANY PRIZE, WINNER ACCEPTS THE PRIZE WITH NO FURTHER OBLIGATION FROM SPONSOR OR ITS AFFILIATES, AND AGREES TO RELEASE AND HOLD HARMLESS SPONSOR, ITS AFFILIATES, PARENTS, SUBSIDIARIES, AGENTS OR CONTRACTORS AND THEIR EMPLOYEES, OFFICERS AND DIRECTORS (“RELEASED PARTIES”) FROM AND AGAINST ANY AND ALL CLAIMS OR CAUSES OF ACTION RELATING TO OR ARISING OUT OF ENTRY IN THE CONTEST OR RECEIPT OR POSSESSION, USE OR MISUSE OF ANY PRIZE OR ELEMENT THEREOF. Sponsor, its respective affiliates, parents, subsidiaries, agents and employees are not responsible for late, lost, illegible, incomplete, stolen, misdirected, illegitimate, or impermissible submissions or mail; postage due mail; or any other error whether human, mechanical or electronic. Proof of sending or submitting a Contest Entry will not be deemed to be proof of receipt by Sponsor.

Promotion results will be available 20 days after the close of a Promotion Period. Requests must be received within 90 days from the end of the Promotion Period.
